(“Mercurial AI,” “we,” “us,” or “our”) understands your concerns with regard to how information about you is used and shared, and we appreciate your trust that we will use and share information about you carefully and sensibly. This Privacy Policy (this “Policy”) applies to information about you collected when you interact with our website at www.mercurial-ai.com, the CarePilot application and CarePilot online portal available at https://app.mycarepilot.com (together with any other supporting websites that we may make available, and the mobile and touch versions of any of the foregoing, collectively, the “Platform”), as well as the associated personalized educational information based upon a review of your medical records by Mercurial AI’s artificial intelligence (“AI”) technology (collectively, “Services”). This Policy describes what information we collect about you in relation to your use of the Platform and Services, how we collect it, how we use it, with whom we may share it, and what choices you have regarding it.

By clicking “accept” or otherwise accessing or using the Platform and Services, you agree that you have read and understand this Policy and that you accept and consent to the privacy practices (and any uses and disclosures of information about you) that are described in this Policy.

Generally, we use this information in the aggregate to help us improve the Platform and make it more compatible with the technology used by our visitors. However, we may combine it with other information in an attempt to identify you or we may combine it with information that does identify you. We may also review our server logs for security purposes – for example, to detect intrusions into our network – and we might share our server logs, which contain visitors’ IP addresses, with the appropriate investigative authorities who could use that information to trace and identify you.
Information collected by cookies, pixel tags, and other technologies. We use “cookies”, pixel tags, and other tracking technologies to collect information and support certain features of the Platform. A cookie is an element of data that can be sent to your browser, which may then store it on your system. Cookies are used on the Platform to allow access to certain secured functions and better serve you when returning to the Platform. Cookies do not contain any personal information about you and are not written into your hard drive. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it or not.

We may disclose your information for a business purpose to our third-party service providers, such as payment processors, website hosts, and analytics providers, that help us to support the Platform and provide our Services to you. We may also disclose aggregated, de-identified information, and analyses and reports derived from such information, to our service providers.
We may use analytics providers, such as MixPanel, to measure and report how users interact with the Platform, and to analyze the traffic to the Platform and for the other purposes as set forth in this Policy. You may opt out of the use of MixPanel in the settings tab of your profile.
We may disclose your information: (i) if we are required to do so by law, legal process, statute, rule, regulation, or professional standard, or to respond to a subpoena, search warrant, or other government official request; (ii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss; (iii) in connection with an investigation of a complaint, security threat, or suspected or actual illegal activity; (iv) in connection with an internal audit; or (v) in the event that Mercurial AI is subject to mergers, acquisitions, joint ventures, sales of assets, reorganizations, divestitures, dissolutions, bankruptcies, liquidations, or other types of business transactions. In these types of transactions, your information (including personal information) may be shared, sold, or transferred, and it may be used subsequently by a third party.
In some instances, Mercurial AI may be acting as a “Business Associate” to your treating provider pursuant to the Health Insurance Portability and Accountability Act (“HIPAA”). Please be aware that, in those cases, our use and disclosure of your Protected Health Information is governed by HIPAA and our agreements with your treating provider.

We offer certain choices about how we communicate with you and what information we obtain about you and share with others.
Account. If you have registered an account on the Platform, you can update, modify, or delete certain of your account information and preferences after you log into your account using the features and functionalities available there. You may also contact us at the email address below for assistance in updating, modifying, or deleting any of your information.
Email preferences. You may opt out from receiving future promotional or informational emails from us by following the instructions for unsubscribing in the emails we send to you or by contacting us at the email address below. However, you cannot opt out of transactional emails related to your account registration or other transactions with us.
Do Not Track. While we take reasonable steps to protect the privacy of our Platform visitors, we cannot promise that the current limitations of our online applications programming will address every browser setting or honor every personal browser preference. In particular, we have not implemented the necessary program changes to honor “Do Not Track” or “DNT” browser signals. Cookies. Most web browsers automatically accept cookies, but you can change your browser’s settings to disable all or certain cookies if you wish. Please be aware that if you change the preferences on your device to prevent or limit your device’s acceptance of cookies, this may prevent you from taking advantage of some of the features on the Platform.
The Platform is hosted and operated in the United States. The Platform and Services are not intended for visitors from outside of the United State. Users from jurisdictions outside the United States visit us at their own choice and risk.
If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information outside your home jurisdiction, and that we may store your personal information in the United States or elsewhere. Please note that the level of legal protection provided in the United States from which you may access the Platform may not be as stringent as that under privacy standards or the privacy laws of other countries, possibly including your home jurisdiction.
We will keep your information for the period necessary to fulfil the purposes described in this Policy, and until your account is terminated or you ask us to delete your information.
We may provide links to external sites as a convenience to you. The inclusion of any link does not imply Mercurial AI’s endorsement of the external site company, its website, or its products or services. When you leave the Platform to visit one of these linked sites, the only information transferred to the third party is the fact that you came from the Platform. This practice allows the third party to monitor its own website traffic, but does not provide them with any information about you. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for other sites’ content or privacy practices.

We have implemented reasonable physical, technical, and organizational security standards designed to protect your information from unauthorized access, use, disclosure, or destruction. We strive to protect your personal information through the use of security technologies and procedures, such as encryption and by limiting access only to authorized individuals. However, no system or procedures are entirely secure or failsafe, and we cannot and do not guarantee the security of your information.
The Platform and Services are not intended for use by children under 18 years of age (“Minor Child”). We collect personal information about a Minor Child to the extent you expressly provide it to us on the Minor Child’s behalf, in which case you acknowledge and agree that you have provided consent for the collection and use of personal information related to that Minor Child. If you are under 18, do not use or provide any information on the Platform or Services or on or through any of their features, including your name or email address. If we learn we have collected or received personal information from a Minor Child without parental consent, we will delete that information. Comments, suggestions, or other such unsolicited ideas and concepts sent to us via the Platform will not be treated as confidential and will become the property of Mercurial AI. We will not have obligation of any kind with respect to such comments, suggestions, ideas, or concepts and will be free to use and distribute any such submissions without limitation, including, but not limited to, developing and marketing the concepts without obligation to the party making the submission.
